ARCHIVE – Copyright Release 2022

By accepting to submit a paper or presentation to the ITE Canada for the CARSP/ITE Canada 2022 Conference, you automatically grant a copyright licence to the Canadian Institute of Transportation Engineers (ITE Canada) for your submitted works under the conditions outlined below. If you do not agree with these terms, you are to notify ITE Canada prior to accepting the opportunity to present your work. You may do so by email at admin@itecanada.org.

You, the Author(s), desire that the submitted Works be included in ITE Canada’s publications and online distribution channels, and wish to licence all copyright in the Works; therefore, the Author(s) agree as follows:

  1. Except for this Licence, the Author(s) retain title to and ownership of the Works
  2. Acceptance, publication and/or distribution of the Works by ITE Canada is sufficient consideration for this Licence
  3. The Author(s) hereby grant to ITE Canada a royalty-free, non-exclusive, worldwide, and perpetual licence to use the Works without limitation, including but not limited to the right to reproduce, copy, publish, print, reprint, reuse, broadcast, transmit, translate, publicly display and distribute the Works, in any media or material form whatever, and waive any moral rights in the Works in favour of ITE Canada
  4. The Author(s) warrant that:
    1. the Author(s) are the sole owners of all rights in the Works;
    2. the Author(s) have full power and authority to enter into this agreement;
    3. the Works are original creations of the Author(s) and are not copied from any copyrighted materials that are not original creations of the Author(s), otherwise any such materials appearing in the Works appears with the written permission of the copyright owner of such materials and such permission is hereby attached;
    4. the Works do not violate or infringe any existing copyright, trade-marks, trade-secrets, patents, or other proprietary rights of third parties; and e. neither this Licence, nor the Works themselves, infringe any contractual obligations between the Author(s) and any third party, and the Author(s) have obtained all necessary permissions that will permit use of the Works as set out in this Licence, and such permissions are hereby attached.
  5. The Author(s) agree, jointly and severally, to fully indemnify ITE Canada from any and all losses, damages, costs, and expenses (including legal costs on a solicitor-client basis) incurred by ITE Canada or its agents or assigns, arising out of this agreement or any claim that the use of the Works infringes any rights of any third party
  6. The Author(s) further agree that:
    1. this Licence contains the entire agreement between the Author(s) and ITE Canada;
    2. this Licence binds and inures to the benefit of the Author(s) and ITE Canada and their respective heirs, agents successors and assigns;
    3. CITE may assign or sub-licence this agreement without the consent of the Author(s);
    4. this Licence cannot be revoked or altered except by mutual written agreement of the Author(s) and ITE Canada;
    5. this Licence may be executed in counterparts;
    6. this Licence is governed and interpreted exclusively by the laws of Canada, and any disputes shall be resolved or brought in Ontario;
    7. unless otherwise specified herein, words importing the singular include the plural and vice-versa; and
    8. ITE Canada is under no obligation to publish or distribute the Works and may do so at its sole discretion.
